RE: Formal Demand Regarding Unlawful Geoblocking and False Advertising
Dear Sir or Madam:
I am a licensed attorney in the State of Washington, USA, writing on behalf of myself regarding the unjustified suppression of my BitChute channel, AurigaBooks. This channel, which is currently geo-blocked in Europe, complies fully with lawful standards of protected expression and does not violate any applicable laws or platform policies.
BitChute advertises itself publicly as a “free speech platform.” However, the geo-blocking of AurigaBooks—which does not contain defamation, incitement to violence, or any unprotected speech under U.S. law—stands in direct contradiction to that representation. The channel is primarily used to promote my published works and facilitate discussion on topics protected under the First Amendment. The European block constitutes an unjustified restriction on lawful expression and commercial speech. The concept of “incitement to hatred,” even if invoked under vague or overbroad European standards, is not a recognized or enforceable limitation under U.S. constitutional or commercial law.
The suppression of my channel has had a measurable chilling effect, including diminished book sales and reduced international reach. These are foreseeable and avoidable harms caused by BitChute’s censorship practices.
Moreover, BitChute’s marketing claims as a “free speech platform” constitute commercial representations under United States law—including the Washington Consumer Protection Act (RCW 19.86) and relevant federal laws enforced by the Federal Trade Commission (FTC). Advertising oneself as a platform for free expression while selectively and arbitrarily restricting lawful content may constitute false or deceptive trade practices. Consumers and creators rely on such representations in deciding where to share and promote their work. If BitChute engages in content suppression without legal justification, it undermines its own claims and exposes itself to liability.
Accordingly, I hereby demand the following:
Immediate removal of all geoblocking and content restrictions applied to AurigaBooks, particularly in Europe;
Written confirmation within ten (10) days that no future suppression will occur absent clear legal cause and prior notice;
A written explanation of the basis for the European block, including whether any governmental pressure, automated filtering, or internal policy triggered the restriction.
You are further instructed to preserve any and all internal communications, moderation logs, access-control decisions, and correspondence relating to the restriction of my channel—including any contact with third-party governments or moderation contractors.
If BitChute fails to resolve this matter amicably, I will pursue all available legal and administrative remedies. This includes filing a complaint with the FTC, initiating civil action under state and federal consumer protection laws, and contacting legal advocacy organizations focused on free expression and platform accountability.
This letter does not waive any of my rights or remedies, all of which are expressly reserved.
